Two offshore wind giants have put their monthslong legal dispute to rest.
Vineyard Wind and its turbine supplier, GE Vernova, this week announced they reached an “amicable settlement” that resolves “all outstanding litigation.” Vineyard Wind sued the supplier in April, alleging GE Vernova was breaching its contract and planning to abandon the project before completing final commissioning work to bring any remaining turbines online.
Vineyard Wind said it was owed more than $800 million from GE Vernova stemming from construction delays due to the catastrophic blade failure in 2024. GE Vernova said Vineyard Wind owed it more than $300 million.
In June, a judge in Boston ruled in Vineyard Wind’s favor, blocking GE Vernova from exiting the contract agreement to service and maintain the turbines. GE Vernova appealed the ruling in July, and as recently as Aug. 31 filed documents asking the higher court to overturn the Superior Court judge’s ruling.
The companies issued identical statements which said GE Vernova withdrew its notice of contract termination, and “both parties have agreed to dismiss all pending legal claims.” They said the terms of the settlement agreement are confidential.
Filings from Wednesday show the parties filed for dismissal with prejudice, meaning it is permanently dismissed in Superior Court. It also means the injunction issued in June is no longer in effect.
Vineyard Wind said “all turbines are capable of producing power,” though it is not clear whether that means they are fully commissioned. This spring, Vineyard Wind attorneys said the project was far from producing the power it contractually promised to deliver. In May, the project’s CEO in a filing said the project “cannot survive at its current levels of actual power production.”
When Light reporters visited the wind farm in early May for about one hour, they counted only about 15 of the 62 turbines spinning.
The Light contacted Vineyard Wind on Thursday asking for average output this month. According to federal data, the project’s output in the second quarter (April, May and June) of 323,600 megawatt-hours was a slight decrease from the first quarter (January, February and March), when it sold about 358,000 megawatt-hours of energy. Generally, output is higher in the winter, when wind speeds are higher.
When the project was still under construction last spring (April, May and June of 2025), Vineyard Wind sold about 57,000 megawatt hours of energy.
