Immigration agents blocked the car that a Guatemalan man and his wife were driving in and smashed a window to detain him without presenting a warrant on Monday. Credit: Gerardo Beltran Salinas with provided video

A Guatemalan immigrant with no Massachusetts criminal record was arrested Monday on Tallman Street after federal agents shattered the glass on his vehicle as he and his wife waited inside the car for their lawyer to arrive.

Juan Francisco Méndez, 29, who was taken to an undisclosed location, has been in the United States for two years and was undocumented, but pursuing an adjustment of his immigration status, according to his attorney, Ondine Gálvez. Méndez’s wife, Marilú, a beneficiary of an asylum program, had petitioned for him so he could regularize his status. They are the parents of one child.

Gálvez said Méndez has no criminal record. A name and date of birth search in the Massachusetts judicial system showed that Méndez has no criminal record in the state, according to a clerk at the New Bedford District Court.

According to Marilú, the couple had just left their home when they noticed unfamiliar vehicles parked along their street. Despite this, they continued on their way until three cars blocked them in. Armed men wearing green bulletproof vests ordered them to get out of the vehicle, she said.

In video shot by Marilú and shared with The Light, one of the agents demanded that they open the door. Méndez replied that he would comply once his lawyer arrived, who was already on her way to assist him.

“Roll down the window so we can talk,” another agent insisted, while Méndez’s wife asked if they had an arrest warrant for her or her husband.

The tense standoff took about 30 minutes. The couple were taken from their car after an agent smashed in the rear right window.

“They pulled us out violently. They treated us very harshly,” Méndez’s wife recalled through tears.

“They are acting with total impunity,” said Gálvez, referring to the federal agents — one of whom was wearing a vest labeled “FBI.”

“Imagine if a child had been in that car. I’m ashamed of what this country is becoming,” she added.

Representatives from several local organizations, including the Centro Comunitario de Trabajadores, Community Economic Development Center, and Mujeres Victoriosa, arrived on the scene to support Méndez and his wife. 

The representatives tried to file a report with the local police. However, an officer from the New Bedford Police Department at first refused to take the complaint, stating that the federal agents were not accountable to municipal law enforcement, a Light reporter on the scene observed. However, a police officer later took the complaint and gave Méndez’s wife a piece of paper with an address and a serial number.

On Monday afternoon, Méndez contacted his wife from custody. “He called me to ask for the lawyer’s phone number. He didn’t tell me where he is,” said Méndez’s wife.

At least 15 people have been detained by federal agents in New Bedford since Jan. 20, the date the new administration took office.

Between March 18 and 23, U.S. Immigration and Customs Enforcement conducted what it called an “enhanced enforcement operation” across Massachusetts, resulting in the detention of 370 people the agency described as “illegal aliens,” including 205 who “had significant criminal convictions or charges.” The Light has confirmed that at least eight of those arrests took place in New Bedford, bringing the city’s total to 15 ICE-related detentions since the inauguration of President Donald Trump.

Among those detained were José Antonio Garcia Garcia, 39, and Miguel Ordoñez Sorocop, 35. According to several teenagers who were in the home at the time, ICE agents entered the house without a warrant on March 21, using a battering ram and wearing military-style fatigues. The agents pointed their weapons at the children’s faces as they were eating breakfast before school.

Others detained in New Bedford include three Guatemalan workers from the Minit Man Car Wash on Purchase Street and one worker from Bob’s Tire on Brook Street. These arrests are part of a broader enforcement trend in the city that has raised concerns among local residents and community leaders.

The use of Gestapo tactics to arrest and detain people in this country for deportation without a warrant or opportunity for representation by a lawyer in court is a violation of the US Constitution. The US Constitution states” We the People” not we the citizens. The founders meant it to apply to all residents. We are all entitled to due process and the opportunity to defend ourselves in a court of law. If this administration can make these people disappear to a prison camp, either in this country or another dictator-ruled country such as El Salvador, then this administration can do it to any of us, even citizens such as your neighbor, your relative or even you. This is just one of the many ways in which this administration is violating our US Constitution which the President and his Cabinet have sworn an oath of office to protect. We should all be out on the streets protesting this.

      1. How did they identify that he was who they SUSPECTED he was? Being present in the United States without proper legal authorization is not, in itself, a criminal offense. While federal immigration law does address the issue, the violation is considered a civil infraction, not a criminal one. This means that a person may face removal (deportation) proceedings and potential fines, but they cannot be charged with a federal criminal offense simply for being present in the country without proper documentation. It is, LITERALLY, what DUE PROCESS is for: to determine who someone is and what, if any, violations have occurred and what can and should be done.

        DUE PROCESS does not occur in the three hours it takes to pull someone out of a car and disappear them to a holding cell states away (or a prison in a foreign country.)

      13. You are incorrect. Due process applies regardless of citizenship status. These are abductions intended to create compliance in citizens and non-citizens alike by spreading fear. The current regime are the real domestic terrorists.

      14. Being undocumented is a civil violation, not a criminal one. Entering without inspection can be a misdemeanor on the first offense, and reentry after removal can be a felony, but simply being present without status is not a crime under federal law. That is why immigration proceedings happen in civil court, not criminal court.

        The Constitution still applies. The Fourth Amendment protects everyone on U.S. soil, citizen or not, from unreasonable searches and seizures. Warrantless arrests inside a home or vehicle without consent or probable cause violate those rights. No criminal court would accept an arrest like this without a warrant or immediate threat.

        Lacking legal status does not mean you lose your rights or can be treated with force and fear. The law requires evidence, warrants, and a legal path to defend yourself. This was not law enforcement. It was an abuse of power.

        It is a letter informing our, then government, that we will separate from them.
        From the moment that King George received it, we were a separate government…

        It took the Continental Congress time to iron out our Bill of Rights, which would codify one’s individual rights and protections from our own government, and the protections from all foreign entities.
        So, all American people born and living, in the original 14 Colonies, at the time of the signing of “We the People”, up until our Bill of Rights were codified, all of these people were automatically US citizens.
        Anyone after this, had to conform to the Bill of Rights, and it’s amendments.
        “We the People” has always indicated ‘we the citizens ‘.
        If our present laws have changed the original intent of founding documents, I am simply not aware of it, or it has been changed unlawfully.

        1. On April 10, 2025, the US Supreme Court ruled unanimously that Abrego Garcia was illegally removed from the United States to El Salvador. Scotus ruled that the US Justice Department is required to “facilitate” his release from custody in El Salvador and to ensure that his case is handled as it would have been handled had he not been improperly sent to El Salvador. This means that the original meaning of “We the people, in order to form a more perfect union” , does mean all the people and not just citizens. The Bill of Rights expands on the 7 articles in the US Constitution, but does not change them. The Bill of Rights, 14th and 15th amendments, 19th amendment, etc, improve on our U.S. Constitution and help our country to achieve that more perfect union.

    4. Really ?? If you’re ordered to get out of your car by a federal agent and you do not comply, you are under arrest, you are now responsible for any means by which authorities enter your vehicle period.

Do you believe those should be arrestable offenses, requiring armed agents to destroy personal property in order to forcibly detain a subject suspected of a violation? Are you starting to understand how important it is that violation of civil law does NOT make one a criminal?

The current President of the United States has said that people being arrested are BAD people who deserve to be deported to these for-profit prison camps without the opportunity to prove that they are innocent until proven guilty. He also uses the word BAD a lot to describe those who disagree with his policies. This includes civil servants, lawyers who defend his opponents, universities that allow free speech, and judges who rule against him in the many lawsuits filed against him for his violations of the United States Constitution . His administration is currently considering the possibility of deporting BAD citizens..
    THINK ABOUT IT! He is rewriting the definition of what this word means. To him, BAD means whatever he dislikes. This happens in dictatorships, where political opponents like Navalny can be disappeared to a Russian Gulag and die there because he wanted to oppose the Russian dictator, Putin.
    WE SHOULD ALL BE ALARMED ABOUT THIS.

    1. You automatically do have more rights as a citizen. You can vote in a national election. You are eligible for all sorts of grants and programs than are not open to non-citizens, like fellowships for college, Small Business loans, etc. But lots of rights — like the right to assemble, the right to habeas corpus –are shared by all. That makes America great –except, that is, when the government itself violates those rights.

Just because it was not presented or show in the very one sided video doesn’t meant they didn’t have cause or have a warrant. The interaction was 30 minutes and you have just watch three of those minutes and many of you are now claiming it was unjust but you have very few facts.

  24. We need to have trainings for migrant workers on how to deal with ICE agents. And ICE needs to speak Spanish and/or bring translators or translation apps. That said, it looks like the agents can’t hear the individuals AND do not know Spanish. Nor did the folks know English phrases like “waiting for lawyer” and did not use a translation app. Is ICE allowed to break into personal property to question people? I hope national media picks this up. The city’s fish-processing plants and manufacturing facilities should work with their workers better to prepare them for this with info about rights, cards with phases like “I called my lawyer.” They have had time to prepare after the raids 15 years ago.

    1. They don’t have that legal authority, no. FBI can, but only with a warrant or probable cause. If they’re just sitting in a vehicle, not attempting to move, they do not have probable cause, the people in the vehicle are legally considered detained.

Over 900 Russians have been jailed for opposing Putin’s corruption and Putin’s “Special Operation” or invasion of Ukraine. Woe to any Russian who dares call it a War and not a “Special Operation”.

    Our President admires Putin. He also admires President Erdogan of Turkey, who recently jailed his political rival . Last month Erdogan jailed Imamoglu, the mayor of Istanbul and one of Erdogan’s most formidable rivals in their next presidential election.

    To Putin and Erdogan, the definition of a crime is what they say it is, and they believe it is a crime to criticize or oppose them in any way. Our president greatly admires these dictators. Our president has advocated impeaching judges who rule against him in court. We should be asking ourselves ,

  27. The people to blame here are the lawmakers who encouraged people from all over the world to invade this country. The open border policy is a disaster for all Americans. My sister in law worked all her life and needs low income housing. She is a widow 77 years old with a very small income. Housing tells her it is a six year waiting list because of the illegals with children come first.

    1. America has not had an open borders policy in recent memory. Democrats, sadly, are almost as draconian as Republicans on immigration, especially in detaining and deporting undocumented immigrants and stopping illegal border crossings.     If I make a traffic violation and I refuse to open the door when told to do so because I want my lawyer, they’re 100% going to drag me from the car too.

For 200 years, Europe dumped the lower-end of its gene pool onto the shores of this country. State like Virginia and Massachusetts were effectively English penal colonies for over 150 years.   37. It is not criminal offense to be in this country undocumented. It is a civil offense for which you can be deported.

    What is offensive is ramming into someone’s home, bashing their car windshield, pointing guns at their children, using aggression and violence, and basically treating these people like FBI’s most wanted people who have NO CRIMINAL RECORD. It’s over the top ridiculous and shameful.

    These are active members of our society who work and contribute and can’t get anything back for the taxes they pay. They are not hardened criminals. They are just people with families.

    There are lots of non-violent ways to deport people. This administration’s approach to these detentions is fueled by hatred and bigotry, not some urgent need to get rid of these specific individuals who are doing no harm. They conduct these raids as if they have watched too many action movies and want to play at being some sort of military hero in real life.

    Send immigrants orders for deportation if that’s what this administration wants AND they are here illegally. But for the love of all that is good about our country, this violence is wholly unnecessary.

    So many people who are here legally and have done nothing wrong other than be born elsewhere are caught up in this with no due process. This isn’t the American way. Every single person in this country is here because of their family immigrating from somewhere.

    My grandfather came from Sweden. My daughter in law from Ethiopia. My son in law from Bolivia. My other ancestors from Denmark and England. One came over as a slave from Angola.

    My dear friend lost her status temporarily due to an abusive relationship and her husband with the work visa leaving her here stranded with two children. She did find a way to stay and get her green card, but she was “illegal” for a period of time.

    This is not a black and white issue, and a sledgehammer approach does far more harm than good. Not to mention in many cases unconstitutional.

As a result, every educational opportunity was stripped from me. Years of psychotherapy have enabled me to finally attain a measure of success in this “land of opportunity”. I am now in process of taking my talents and achievements elsewhere where people retain a sense of decency and humanity. I realize no place is perfect but this place has slid all the way into the gutter and I’m getting out before those concentration camps are opened again here and we start seeing people hanging from trees again. Otherwise you do not have to open your door. The lack of humanity these ICE officials are displaying here and across America is disgusting.
